لا يحتاج أي شخص أن يكون خبيراً مالياً أو اقتصادياً أو إدارياً أو قانونياً لكي يقول رأيه في الفضيحتين المدويتين اللتين أعلنت عنهما مؤخراً هيئة السوق المالية السعودية، والمتعلقة بشركتين كبيرتين مدرجتين في السوق. أي شخص لديه مقدار بسيط من القيم الدينية والأخلاقية لا أكثر يستطيع أن يقول رأيه في: (التلاعب، التضليل، الاحتيال، الغش، الكذب، الخداع، التدليس)؛ لأنها ذنوب تحرمها كل الديانات، وآفات أخلاقية ممقوتة في أي شكل من أشكال التعاملات بين البشر، فكيف عندما تكون نتيجتها إلحاق الضرر النفسي والمادي بأعداد كبيرة من الناس وهم يفقدون أموالهم التي اعتقدوا أنها تدار بأيدٍ أمينة، وإذا بهم يكتشفون أنهم عصابات من الفاسدين والمحتالين والنصّابين.

ثمانية وعشرون رأساً في شركتين شهيرتين تمت الإطاحة بهم خلال أقل من 48 ساعة. في الشركة الأولى تمت إحالة 17 مشتبهاً من كبار مسؤوليها السابقين والحاليين إلى النيابة بتهم جسيمة بعد التحريات الدقيقة، وسوف تظهر لاحقاً نتيجة التحقيق والأحكام التي سوف تصدر بحقهم. وأما في الشركة الثانية فقد صدر القرار القطعي بالإدانة ضد 11 شخصاً في مجلس الإدارة ولجنة المراجعة، وتضمن القرار غرامات مالية بلغت نحو 18 مليون ريال، ومنع عدد من الأسماء من العمل في الجهات الخاضعة لإشراف هيئة السوق المالية لفترات تصل إلى عام كامل.

ومنذ انفجار الفضيحتين المتعلقتين بشركة «سينومي ريتيل» وشركة الشرق الأوسط للرعاية الصحية/«السعودي الألماني الصحية» وهما حديث المجتمع في منصات التواصل، وهو حديث تشوبه الخيبة والاستياء والتساؤلات الكبيرة حول استطاعة الشركتين الاستمرار في مخالفاتهما رغم تكاثر الشبهات حولهما. وعلى سبيل المثال فإن قرار إدانة مسؤولي شركة السعودي الألماني الصحية كان على مخالفات بين 2018 و2021، أي خلال أربعة أعوام فقط، والله أعلم ماذا حدث قبلها وبعدها، ورغم أن بعض المختصين في هذا المجال قد أشاروا علناً في أوقات سابقة إلى المخالفات الفاضحة التي تمارسها هذه الشركة، فأين كانت هيئة السوق المالية وهيئة مكافحة الفساد والنيابة العامة عن كل ما أثير آنذاك.

ورغم تقديرنا لضبط ما كان يحدث في هاتين الشركتين إلا أنهما بالتأكيد لا تكشفان سوى رأس جبل الجليد الذي ما زالت تتخفى تحته كثير من الشركات، فهل نستبشر بأن مرحلةً تصحيحية جديدة صارمة قد بدأت، تحدّ من العبث والاستهتار والإضرار بسمعة سوق المال وجاذبية الاستثمار في المملكة، وتحفظ حقوق المساهمين الصغار الذين تحولت أموالهم إلى أرصدة المساهمين الكبار، وهل سنرى عقوبات مغلّظة تناسب الجُرم الذي يرتكبه أمثال هؤلاء المحتالين.

في بلدان أخرى هناك عقوبات شديدة تصل إلى غرامات باهظة، ومنع تام من العمل في هذا المجال، وأحكام بالسجن لمدة قد تطول، ولكن ما نشاهده من عقوبات لدينا إلى الآن لا يبدو كفيلاً بردع المخالفين. المحتال الثري من نهب أموال الناس لا يستحي من فضيحة التشهير، ولا تهمه غرامة تافهة بالنسبة لثروته، ولا إيقاف مؤقت عن ممارسة العمل يعود بعده أكثر شراهة. دعونا نقول للمحتالين: «كفاية دلع»، كما قالها أحدهم ذات نصيحة.

No one needs to be a financial, economic, administrative, or legal expert to express their opinion on the two major scandals recently announced by the Saudi Capital Market Authority, related to two large companies listed in the market. Anyone with a basic sense of religious and moral values can voice their opinion on: (manipulation, deception, fraud, cheating, lying, trickery, and misrepresentation); because these are sins condemned by all religions and are moral vices detested in any form of human dealings. How much more so when the result is causing psychological and material harm to large numbers of people as they lose money they believed was being managed by trustworthy hands, only to discover they are dealing with gangs of corrupt individuals, fraudsters, and con artists.

Twenty-eight executives from two well-known companies were ousted in less than 48 hours. In the first company, 17 suspects among its former and current senior officials were referred to the prosecution on serious charges after thorough investigations, and the results of the investigation and the verdicts against them will be revealed later. In the second company, a final conviction was issued against 11 individuals on the board of directors and the audit committee, and the decision included financial fines amounting to about 18 million riyals, along with a ban on several names from working in entities under the supervision of the Capital Market Authority for periods of up to a full year.

Since the eruption of the scandals related to “Sinemoi Retail” and the Middle East Healthcare Company/”Saudi German Health,” they have been the talk of the community on social media, a discussion tinged with disappointment, resentment, and significant questions about the ability of the two companies to continue their violations despite the growing suspicions surrounding them. For example, the conviction of the officials of the Saudi German Health Company was based on violations that occurred between 2018 and 2021, just over four years, and God knows what happened before and after that. Although some specialists in this field have publicly pointed out the blatant violations practiced by this company in previous times, where was the Capital Market Authority, the Anti-Corruption Authority, and the Public Prosecution regarding all that was raised back then?

While we appreciate the crackdown on what was happening in these two companies, they certainly only reveal the tip of the iceberg that many other companies are still hiding beneath. Can we hope that a new strict corrective phase has begun, one that limits the chaos, negligence, and harm to the reputation of the financial market and the attractiveness of investment in the Kingdom, and protects the rights of small shareholders whose money has turned into the assets of large shareholders? Will we see severe penalties commensurate with the crimes committed by such fraudsters?

In other countries, there are severe penalties that include hefty fines, complete bans from working in this field, and prison sentences that can be lengthy. However, what we have seen in terms of penalties so far does not seem sufficient to deter violators. The wealthy fraudster who steals people’s money is not ashamed of the scandal of exposure, does not care about a trivial fine compared to their wealth, and does not mind a temporary suspension from work, only to return more voraciously. Let us tell the fraudsters: “Enough pampering,” as one of them once advised.
