تخطّط إدارة الرئيس الأمريكي دونالد ترمب لسحب الجنسية من 17 أمريكياً متهمين بارتكاب احتيال في قضايا هجرة، في إطار توسيع حملة غير مسبوقة لإجراءات إسقاط الجنسية.

أكبر تحرّك لإسقاط الجنسية

ونقلت شبكة CBS News عن مسؤولين في وزارة العدل قولهم: إن هذه الخطوة تمثل أكبر تحرك في تاريخ الولايات المتحدة لاستخدام صلاحيات إسقاط الجنسية، وهي صلاحيات نادراً ما جرى اللجوء إليها قبل عودة ترمب إلى البيت الأبيض العام الماضي، مع وعود بإطلاق حملة ترحيل واسعة.

وتشير بيانات تاريخية إلى أنه بين عامي 1990 و2017، رفعت وزارة العدل في المتوسط نحو 11 قضية سنوياً فقط لسحب الجنسية من مواطنين أمريكيين.

وينص القانون الفيدرالي على إمكانية سحب الجنسية من المولودين خارج الولايات المتحدة إذا ثبت حصولهم عليها عبر الاحتيال، مثل إخفاء معلومات تتعلّق بسجلهم الجنائي في طلبات الهجرة.

إلا أن هذه الإجراءات كانت تاريخياً معقدة وطويلة ونادراً ما تُستخدم، إذ يتعين على السلطات إقناع القضاء بسحب الجنسية عبر محاكمات مدنية أو جنائية أمام المحاكم الفيدرالية.

جرائم تستدعي سحب الجنسية

وفي عام 2025، وسعت وزارة العدل فئات المواطنين المجنسين الذين يمكن استهدافهم بسحب الجنسية، فيما أعلنت الشهر الماضي 12 قضية مماثلة كانت الأكبر منذ سنوات.

وبحسب السلطات، فإن بعض المستهدفين في الحملة الأخيرة، وعددهم 17 شخصاً، أُدينوا بجرائم عنف أو جرائم خطيرة، بينها اعتداءات جنسية على أطفال، بينما أُدين آخرون بجرائم احتيال، أو وُجهت لهم اتهامات بالاحتيال في قضايا هجرة.

وجاء في الشكاوى المقدمة أمام محاكم فيدرالية أن هؤلاء الأشخاص «أخفوا أنشطتهم الإجرامية عند التقدم للحصول على الجنسية الأمريكية، أو أنهم لم يكونوا مؤهلين أصلاً للتجنس، بما في ذلك عدم استيفاء شرط حسن السيرة والسلوك، وهو أحد المتطلبات الأساسية في إجراءات التجنيس».

ووفق CBS فإن الدفعة الأخيرة من قضايا سحب الجنسية، شملت مهاجراً من هايتي يُزعم أنه اعتدى جنسياً على ابنته، ورجلاً من يوغوسلافيا السابقة أُدين بالاعتداء الجنسي على طفل دون سن 15 عاماً، ومهاجراً من المكسيك أُدين بحيازة صور إباحية صريحة لقُصّر، وكاهناً كاثوليكياً سابقاً مولوداً في كولومبيا متهم بارتكاب اعتداءات جنسية على أطفال، ورجلاً مولوداً في الفلبين أقرّ بالذنب في جريمة جنسية بحق طفل.

وشملت المجموعة مهاجراً من الهند متهم بتقديم طلبات تأشيرة عمل احتيالية من نوع H-1B، وابنة تاجر مخدرات كولومبي متهمة بغسل الأموال، ورجلاً مولوداً في جامايكا أُدين بجرائم احتيال إلكتروني، وامرأة مولودة في كوبا متهمة بالاحتيال على كازينو تابع لإحدى القبائل. كما وُجهت اتهامات لآخرين باستخدام هويات مزيفة.

سياسة عدم التساهل

من جانبه، أعلن القائم بأعمال وزير العدل تود بلانش أن الوزارة ستتبع سياسة «عدم التساهل إطلاقاً» مع إساءة استخدام إجراءات التجنيس. وأضاف أن المهاجرين المجرمين يكذبون بشأن ماضيهم الإجرامي، بما في ذلك تجار المخدرات والمعتدون جنسياً والمحتالون.

فيما أكد وزير الأمن الداخلي ماركواين مولين إن إدارة ترمب ستواصل استخدام كل السبل القانونية الممكنة لسحب الجنسية وترحيل الأجانب. واعتبر أن الجنسية الأمريكية امتياز يجب اكتسابه بصدق. إذا أتيت إلى هنا، وخالفت قوانيننا، وكذبت في إجراءات الهجرة، فإنك تفقد هذا الامتياز.

The administration of U.S. President Donald Trump is planning to revoke the citizenship of 17 Americans accused of committing fraud in immigration cases, as part of an unprecedented campaign to expand citizenship revocation procedures.

The Largest Move to Revoke Citizenship

CBS News reported that officials from the Department of Justice stated that this step represents the largest move in U.S. history to utilize citizenship revocation powers, a power that has rarely been used before Trump’s return to the White House last year, with promises to launch a wide-ranging deportation campaign.

Historical data indicates that between 1990 and 2017, the Department of Justice raised an average of only about 11 cases per year to revoke citizenship from American citizens.

Federal law allows for the revocation of citizenship from those born outside the United States if it is proven that they obtained it through fraud, such as concealing information related to their criminal record in immigration applications.

However, these procedures have historically been complex and lengthy and are rarely used, as authorities must convince the judiciary to revoke citizenship through civil or criminal trials in federal courts.

Crimes Justifying Citizenship Revocation

In 2025, the Department of Justice expanded the categories of naturalized citizens who could be targeted for citizenship revocation, announcing last month 12 similar cases, the largest in years.

According to authorities, some of the targets in the recent campaign, numbering 17 individuals, were convicted of violent crimes or serious offenses, including sexual assaults on children, while others were convicted of fraud or faced charges of fraud in immigration cases.

Complaints filed in federal courts stated that these individuals “concealed their criminal activities when applying for U.S. citizenship, or they were not eligible for naturalization at all, including failing to meet the good moral character requirement, which is one of the basic requirements in the naturalization process.”

According to CBS, the latest batch of citizenship revocation cases included an immigrant from Haiti who allegedly sexually assaulted his daughter, a man from the former Yugoslavia convicted of sexually assaulting a child under 15, an immigrant from Mexico convicted of possessing explicit pornographic images of minors, a former Catholic priest born in Colombia accused of committing sexual assaults on children, and a man born in the Philippines who pleaded guilty to a sexual offense against a child.

The group also included an immigrant from India accused of submitting fraudulent H-1B work visa applications, the daughter of a Colombian drug dealer accused of money laundering, a man born in Jamaica convicted of electronic fraud, and a woman born in Cuba accused of defrauding a casino owned by a tribe. Others were also charged with using false identities.

Zero Tolerance Policy

For his part, Acting Attorney General Todd Blanche announced that the department would adopt a policy of “zero tolerance” for the abuse of naturalization procedures. He added that criminal immigrants lie about their criminal past, including drug traffickers, sexual offenders, and fraudsters.

Meanwhile, Homeland Security Secretary Alejandro Mayorkas confirmed that the Trump administration would continue to use all possible legal means to revoke citizenship and deport foreigners. He stated that U.S. citizenship is a privilege that must be earned honestly. “If you come here, violate our laws, and lie in immigration proceedings, you lose that privilege.”
